My friend has two children whose father lives abroad, in Germany. She has been here in Australia since the children were 2 (with court permission). Father contact has been erratic but the mother has made them available (under her supervision, the otherwise children won't go) the last few years when visiting Germany (once a year). The children are now 11 and 10 and do not want to spend time with the father- (have never had established relationship with him or spent any real time with him).
Father wants to come to OZ on holiday and have the children for ten days. The children are refusing to go with him or spend time without their mother. The father says he will take her to family court and engage a lawyer here.
The mother is unsure what to do. The children do not want to see him and refuse the idea. They have said that to the father in person six months ago in Germany when he asked them if they wanted to spend more time with him.
Children are happy and have no issues .
The mother is wondering what the court's view will be as father lives so far away.
