I have a ROC easement running through my land which benefits the neighbour. I am the serviant property.
The ROC is 3.2m wide, but has an awkward angle. It is possible to go around this awkward angle if one drives carefully.
The previous owners of the Neighbouring Property had illegally extended the driveway so it encroached on my land. Much shouting later from me with no resolution, they sold the property. During the change over, I got the lot surveyed within an inch of it's life, and then got the encroachment removed.
The new neighbour was fully aware of the issues with the easement at time of purchase, but still expected to use the illegal extension without my permission. (The husband came to my door to give me a long lecture on "common courtesy" on the second occasion he ever spoke to me.)
They continue to drive over the easement boundary on that corner. I tried building a small stone structure to discourage them, but they have taken to just bouncing over it (it's completely ruined). I have video footage of their daily trespassing and damage.
I want to drop a huge boulder in that corner. Or a series of bollards and chain links along the edge of the easement boundary. I just want to know how close I can build it to the boundary.
As the whole plot is my land, and they can navigate that corner if they go carefully, I'm hoping I can build right up to the boundary, with no limitations.
To clarify - i have NO intention of building anything on the easement. I want to do these works ONLY on my land, but in a way to stop the entitlement and trespassing.
