its the 9 months more of not having a licence that shits me more. I wasn't even on the road so to say I was caught riding is bulls**t and have back up from the owners letter telling then the bike was left at the me spot he left me is insane. Australia has become a police out of control country and do what they like and charge you what every they need to make the quota for the month.

Now your getting it!

Yeah, in a perfect world that would be great. But the guy is a FIFO worker and paying him to take a couple of days off would cost me big time. Cheers for the help, but just hope the judge isn't a dirt bag

I dunno about judges being 'dirt bags'? The problem I see with judges these days is about being closed minded because they have 'heard it all before' - that is the worst type of judge you can get. Because then the case is no longer about you, it is about you and everybody else that came before, and that is not justice.

Yep, can't see it going my way at all. When the cops have no proof of me riding and I have asked them to return the bike. They said it's the law to crush it without even hearing the case. Just plain wrong to assume guilty before proven otherwise. That's Australian courts and cops having more power to serve themselves

It's not about serving themselves, I don't think. It's about priorities. The authorities simply want the system to function without members of the public being able to disrupt it, so they slowly plug all the loopholes and adapt the system over time until members of the public have the least ability to defend themselves as possible. And that's how they like it.

The best way I can describe this attitude that police and authorities in general have, is that they have become 'recalcitrant' towards due process, common sense, fairness and anything a member of the public has to say.

As Rod said, go to Court and fight it... That is what the Courts are for. The Police don't make the final decision.

Being Cynical isn't helping anyone and far too much of that goes on in this forum..

Cynicism is necessary where the law is concerned. Because people need to be aware that no one can guarantee justice will be done, no one can guarantee a win in court, even with what appears to be a good case. I am saying he can still lose even with all that evidence.... of course that does not mean give up, it just means that you go into it with your eyes open.

Don't worry I am going to court to plead my case. This is so wrong. It means that if I had a unregistered dirt bike or any bike, even a car, and parked it on a verge outside my house and washed it and started it for a while to dry the engine off, the cops can come around the corner and see it has no plates and the engine is warm they have the right to impound it and accuse of using unlawfully - that is the statement of the case.

And that would be a 100% correct interpretation of the law.

For your vehicle to be impounded and crushed you have to be a repeat offender.

Stop using vehicles without a licence. It's simple.

No Bill that's the new impound laws for all, not just repeat offender. And if you're not even diving it, if you're on the side of the road and waiting for it to lift from a tow company or friend with trailer and you have started it to make sure it runs, and if you read what happen, I took a cab to the place and called a tow truck not knowing they didn't work Saturday's till I called them. I had to arrange a for friend to pick me up.
