He even lied in the affidavit about mediation that there was no agreement when there clearly was but no signed it cause the chick didn't have a computer

Yes .... If what you were offering & agreed to via mediation was okay then, why not now ... The court won't care if he has been away for several months, they will just be wanting to put in place orders to have the kids rights to a relationship with both parents

An agreement, in order to meet the legal definition has to be signed by both parents & dated

So I can use the mediation plan as evidence we agreed on things even though it wasn't signed

Yes ..... To be honest, it doesn't sound like he is doing himself any favours, & the threat to seek orders is probably just that.. Just offer what you agreed to & see how that goes ... If he agrees, sigh & date a formal agreement ... If he still wants to take it to court, it's his money, & his lost time

Ok perfect so basically if he agrees to do the mediation plan then get it formal and work from there
