Without seeing the application, in general terms, if the Court accepted the application as urgent (meaning a court date was set 28 days after it was filed) then the practice direction would not apply.

so because it's not marked at urgent before it will have no chance of that being changed is that what you're saying?

I have the 23 February so it's almost 10 weeks all up before the court and even from today it's still longer than 28 days

You said you filed the application on an urgent basis.

yes it was filed as urgent on December 20 and I was then given the next day the 23 February I am primary carer

Once again, I haven't seen the application.

But if you say it was filed on an urgent basis, this means you have to put that as an order on the initiating application, and the Court considers it urgent, they will assign it to a judge on the earliest available date.

In that case the practice note is irrelevant.

so basically the court don't consider it urgent and nothing is going to change that.....is that what you are saying?

In the initiating application did you seek an order that your case be heard urgently?
