Hi, we have just finished major renovations and are about to apply for the OC. However, we haven't completed the front fence which is subject to a separate DA. There is hoarding on the front fence preventing entry into the site the works. Does anyone know legally if the hoarding has to come down before the OC will be granted. We want to keep it up as we are in dispute with the council about the front fence. I.e. They wont allow us to built it as per the DCP/LEP for no good reason other than out psych neighbour not wanting it.

The hoarding likely needs to come down for OC approval, as it restricts site access. Disputes with council regarding the fence are separate from the OC process. Seek legal advice regarding the fence dispute and its potential impact on the OC.
