Hi experts :)

I would like to develop my property into a detached dual occupancy with Torrens title subdivision. I have done my research (LEP/DCP) and I know it it possible to do.
Commonly, a dual occupancy is built and the subdivision is registered after the build is complete, however, I would like to sell 1 of the 2 lots in order to fund the build for my new house on the other lot. If I obtain DA approval for the development with subdivision, is it legally possible to then have the subdivision registered so I can sell 1 lot prior to commencing construction? And, if so, can Council condition the DA consent to require the OC to be issued prior to the subdivision being registered?

It sounds like you’ve done thorough research! Subdividing before construction could be a good way to fund the project.

In some areas, councils might require the occupancy certificate before approving subdivision registration, but rules can vary. It’s definitely worth checking if there’s flexibility in your case.
