Hi,

I have been through consent orders and seperation with the ex. I have retained ownership of the house and she has yet to pick up her goods listed in the consent orders. She went over the 90 days of the consent orders, so i had my solicitor inform her solicitor that as she went over the 90 days i retained ownership of her goods.
I gave a set of drawers on her former list to one of my daughters. Since then a week later she has sent me a text to ask for another two weeks to pick up her goods . In my weakness i said yes.
Since the goods were actually mine when disposed , there should be no issue?

Why undermine your own consent orders ? if it ends up in court, how will this look ?

If I were you, I would not have given anything away, I would have wrote saying the time has passed, and either said on date x y z the items will be out the front for collection or will be discarded or sold if your orders said it becomes your property, do not do anything to go against the consent orders, make sure you have complied, then that is that.

Of course if there is minor technical issues etc, you are not going to go to court over that, sometimes a lender etc has delays, just think about what a judge will be thinking, the other party just not making and effort to comply without a compelling reason will be just that. Also, I would have zero contact direct with the other party if you have lawyers. If you are not longer represented, you write to her lawyer. Seek that they comply with the consent orders and you want it finished, no more reasons to hang on and drag it out !
