After supplying you with relevant documentation on this subject I was wondering if a personal opinion could now be given as I believe that this is what this forum is about.
From the documentation supplied you will notice that the Auditors viewed that clause 9.3.1 of the Public Service (non- executive staff-Vic ) 170(MX) award gave the Department the right to reduce certain casual rates.
I dispute this opinion and also offer that clause 9.3.2 of the same award would overrule as the terms and conditions become less favourable than granted by the decision of Senior Deputy President MacBean Print N7486.
Hope to keep this going as this forum will give casuals potentially affected a chance to see what is happening, particularly as this is not the only area that casuals were underpaid in.
