I rode my eScooter inside a kfc store carpark and was going to enter, I was under their veranda area then decided to speed off out (my intention was to try go through drive through with the scooter but didnt) and the footpath out was very misleading. The bricks went from the door to a deadend and a ramp was on the other end. This dead end made me literally fly off, stack it and I ended up fracturing my right knee and required Mris and treatments. Outofpocket almost thousands of dollars, not to mention missed work and constant ongoing pain almost a year later.
I reported this to the store and got contacted asking what is my order number and what did you buy? I said nothing (yet) I was just visiting and he said too bad can't help.
I can go and take photos of what I'm trying to explain.
Can I take legal action?
(I'm sure in places like the US when burglars get injuried whilst trespassing, can sue for damage although unsure what it is in Australia?).
