Thanks so much. We've now discovered that they've varied the Deed and also precluded some creditors from the DOCA with no notice or reason. It's definitely hotting up on this one.

Happy New Year mate, sorry for the delay in replying, I only get back from overseas a few days ago. How are you getting on with this? Do you still need a response to your last question or did the reform act answer it for you?

Happy New Year. Hope you had a great break!

I've discovered so many more irregularities within the DOCA and other suspect transactions, that I'm now at a loss really on which direction to go. The VA crew are refusing to answer my questions and seeking indemnity for costs to answer any more questions about those irregularities.

Pursuing via any court action to terminate the DOCA on the basis that it was oppressive, unfairly prejudicial, or unfairly discriminatory to a small group of creditors will cost money that we simply do not have. This crew have deeper pockets and are unscrupulous. Perhaps I simply put this one to rest and focus my energy on more important things. It's unfair, it's unjust but I've certainly learnt a lot along the way. Hope to put that knowledge to good use.

Thanks so much DM Legal and for checking in. Forums like this help and people like you help us laymen and women navigate the complex aspects of law. Have a great 2019.

Sorry to hear the situation has not panned out how you hoped, indeed it can be costly to take action to terminate a DOCA etc. You're very welcome, all the best for 2019.
