Can an employer rescind an employment offer due to not being able to start on agreed date due to injury sustained prior to starting date. All paperwork was signed and submitted to HR and I was offered a permanent part-time position..
questions to consider :
1 did you get offered to role.?
2 if you did, there is a question whether you have commenced employment already albeit not worked.
3. notwithstanding 1/2 above, it is unlawful to adversely affect someone employment, including a prospective employee for exercising a workplace right. that is if you took sick leave etc and you were not hired/terminated then the employer has potentially breached the FW Act see part 3- 1
