Hi,
my ex husband breached avo, i believe he was within 100 mtrs to my house one night. I think i saw him talking to a person while driving but i am not sure as it was dark. I am worried that it may not be him or its just an illusion on my mind. Matter is taken for court hearing what could be likely sentence? If it's false will i be charged?

You probably won't be charged.

Unless he corroborates your evidence with his own, likely outcome is that it'll get thrown out. It's a criminal matter, which means it has to stand up to the standard of proof being beyond reasonable doubt. In circumstances where it was dark, he was apparently driving, and the only witness was you, the prosecution will probably struggle to get it over the line for a conviction.
