Hi there,

There are some shares left over and my sister claims my mother promised them to her. She is the named executor of will and I am not because I am out of the state. I am not an executor, just a beneficiary.

The will says all is supposed to be shared between her and me 50%, but she claims a month before mother passed away that the shares are for her. She claims mother verbally promised her.

How likely could she succeed in asserting this claim? It's not in the will, so could this stand up in a court of law?

Thanks,

I doubt her claim would stand up in court, but the ugly truth is it could cost the estate a lot to settle.

On one hand if the shares are only a few thousand I would let it slide. But you want to be very suspect on what else she may do if she is going to do this.
