Hi My father has minimal assets/accounts to distribute and should be simple, I am executor. I had been told that probate is not necessary, due to only small furniture left and 2 bank accounts and no house (as went to ex wife immediately upon death due to no settlement done in time). Is probate necessary, as possible read that the executor can't distribute without and there could be a Will dispute?
Main bank said they don't need probate as the investment has a binding sole beneficiary and trustees distribute as per this, as no family law order in place prior.
Problem is also that the investment was mentioned on the Will , as not changed in time, to go to another Will beneficiary NOT named under the investment . Can the person on the Will try override and dispute this?
