My parents have been left an inheritance. The executor of will in control of the estate is causing us problems. My parents want to disclaim the inheritance to do away with the executor. If they do this, the inheritance then goes to the children (stated in the Will). If my parents were to do this, they would lose their Centrelink part pension, which is ok.

My questions are:
- If my parents disclaim, can the executor of will challenge this?
- Once you disclaimed, can my parents take back ownership of the funds if we transfer the funds back into trust so they can live off the interest? Would any legal issue arise from this?
- Are there time limits e.g. from Executors role to Trustee role for the beneficiaries if my parents disclaim where stamp duty becomes payable by the other beneficiaries (children)? We live in Victoria.
