I currently have a DVO to protect myself and my daughter from my ex partner. He was also convicted of stalking charges. He has retaliated with an application for a private AVO. He is using forged documents as part of his evidence over an alleged phone call. The police are aware of this forgery. His lawyer is now threatening to subpoena my 13 year old daughter in order to question her over this alleged phone call and other matters. My daughter has developed severe anxiety over his past actions. She is on medication, sees a youth counsellor and has just been referred to a child psychiatrist to help her through all of this. Is letters from these medical professionals enough to stop her having to obey the subpoena?

Well then surely you recognise it for what it is...
a plot to intimidate you, and her, out of taking the matter further.

Before you do anything else, you need to get pre-emptive.
Take your daughter to a psychiartist, and have a comprehensive report prepared
about her conditon(s).
No, GP won't cut it, neither will a psychologist.
Yes, this will cost money, and no, Medicare may not cover it.

And take yourself to see the Womens Domestic Violence Court Advocacy Service.
