Hi,

I sold a iPad on Gumtree to a guy who purchased it in person at my house. He looked over, said it was fine, paid and left.

4 1/2 hours later, he sends me a text wanting a refund saying he's found a crack in the screen. What are my Australian Consumer Law rights as the seller?

I looked over it and cleaned it before selling and didn't see a crack.

Hi,

It sounds like the buyer doesn't have any right to a refund. I assume there was no crack or he wouldn't have bought it. He was provided adequate right to inspect prior to purchase and failed to find a defect. Paid and took the item. Too late. Let him pursue it. I would stick to my guns.

Agree. He may have dropped the item after purchase. Or be attempting a scam by substituting a broken iPad for your good one.

FYI, to foil scammers buying hi tech equipment it pays to take a photo of the serial number before sale.
