Good morning,

I am wondering, if I have sealed orders for my ex-partner to vacate our joint property, as I have sole occupancy so I can sell the property, do I have to wait for eviction orders from the court?

I also have a DVO and the date to vacate the property is soon. Also if I am to go there on the day it is supposed to be in my possession, and try to enter, what will the repercussion be?

No I don't believe so. If the orders state that your partner must vacate by X date, then he must act upon those orders. Is the DVO in your favour or taken against you?

It's against him my lawyer is waiting for Legal Aid to get back to her as my funding is way over the normal capped price, and she is telling me I have to wait as he is still occupying the property. I am over this whole thing its been going on for 3 years now.
