I have been separated for 9-10 years. My wife walked out, leaving me the house to pay for over the years. I struggled to keep up the payments and in 3-4 years, I will pay out the home loan.

Over that time, we have lived together for about 1.5 years for a few months at a time. Since our separation and she moved out, she took everything and left me with broken things or stuff she did not want. For about 7 years, I have stored her stuff, paying the contents insurance and she has not paid any storage rent.

I feel that I may lose all I have invested, as I have been restoring the home too. Also she is on 3 times the income I am.

Hope you can help me under Family Law.

Hi,

An article regarding property settlements after separation can be found here : Property Settlement After Separation - Rarely a Case of 50:50 - Legal Blog - LawAnswers.com.au

This is another article regarding your property rights after separation: Property Settlement After Separation - Agree Now, Don't Pay Later - Legal Blog - LawAnswers.com.au

It would be wise to contact a lawyer who specialises in family law to look at having a property settlement drafted. See Get Connected with the Right Lawyer for You
to be connected to a local family lawyer.

Why do you think that you might lose everything? Is she trying to negotiate a property settlement? Generally the time limit for applying to the court to obtain property division orders is 2 years post separation for defactos and 1 year from date of divorce for married couples. So its likely she can't take you to court over it, if - as you say - you have been separated for over 9 years.

Just I have struggled to keep the house. When she was here I asked for money but would not help out. I'm just scared I don't have a lot.

I have started collecting bank records thanks for your help. I feel a little safer now.
