NSW Right of residency and Deceased estate

My husband is a beneficiary of his mothers deceased estate and also has right of residency. The will states that if he pre deceases his brothers his share remains in the residue of the property, but if the brothers die first their shares go to their estates. He is concerned now he is married, can his share go to me while we are still living there. His mother died in 1981
