I am in a town house on a standard format, group title. There is a (failing) retaining wall along the side of the property, under the fence but I am not on this side of the property. The retaining wall was built at the time of the town houses, while the up-hill neighbours are recent. My question is, if a retaining wall is on the property alignment and not in common areas, is the owner of the individual property (town house) responsible for replacement or is the body corporate? Everywhere I read tells me on a standard format the individual owner is responsible, but our body corporate manager is telling me otherwise.
