We are a unit on the low side.
A contiguous retaining wall runs about 1 metre within our rear yard and thru four other properties in the street. The wall has common foundations, common piers and common drainage.
The retaining wall has slightly rotated , about 75mm over its height of 1.3 metres.
We have contacted Council and they have been unable to find any plans/permits for the 30 year old brick structure.
The angle of repose is such that the unit on the high side is within 6 metres of the retaining wall, hence nothing can be done without temporarily supporting the land on the high side.
Who is responsible for the cost of repair/replacement ???
