We are now approaching the third year since mums passing and the probate lodged... we have been in constant dispute with our brother the executor and we seem unable to resolve this matter... the estate was settled at the end of the two years and we have simply been waiting for distribution... he raised the matter of his time... loss of income.. and travel expenses amongst other things and we agreed to allow him a fee of almost $8500..
He originally asked for $24000... he agreed to the lesser amount but we feel he is incurring costs to himself as an accountant to benefit personally.. he has been aggressive... and unwilling to meet with the beneficiaries to try and resolve this matter. We do want him removed but do not want to do it at a greater cost to the estate.
Are we able to represent ourselves and what is the order to action his removal.
