Does anyone know if there is a time limit for setting aside Orders made in the Federal Magistrates Court pursuant to r.16.05(2)(a) of the Federal Magistrates Court Rules 2001.

For example if an Order was made in the absence of a party to a proceeding and it was stated in the notation at the end of the Orders that The absent party may apply to have the orders set aside pursuant to the above mentioned rule.

Generally 14 days after they have been served the orders (assumes they are not parenting orders). If you applied and got the orders you wanted, then serve the other party asap so that the matter is not 'hanging around' longer than it should.
