Hi all

Just wondering how long before I can dispose of hubby's belongings/ valuables by property law?

He took most of the belongings 6 weeks ago with the police. I advised them a few days later he didn't take it all, they didn't care much.

I have been sending him a number of texts to come collect his items. Unfortunately, he wants me to drive 40 minutes to leave them with a priest. Not feasible and the priest doesn't want a bar of it. Apparently he's scared of me ;)

It was a very short marriage and he moved into a property which I am the lease holder. What are my options as I frankly don't want his things here considering he also stole of me 5k worth of wedding gift money?

After giving written notice, you can dispose of goods after:

28 days notice for goods <$100
3 months notice for goods between $100 and $500 in value (fair value sale or auction)
6 months >$500 <$5k, with conditions (eg publish notice in NSW state paper, must dispose of by auction).
court order >$5k

And keep records of sale.

Money in excess of your costs goes to state government.
