I was hired by a software start-up company as a software developer with the promise of paying me with company shares (percentage of the company). This was declared in a Memorandum of Understanding (MoU). Apart from the MoU, I don't have any written employment contract.

However, after 5 months they dismissed me without any shares/salary/compensations for my work. During the 5 months my work was shown to potential customers and to win customers.

My question is can ask for any payment for my services, if so what would be the process?
In this situation , Am I considered as an employee?

Thank you.

Suggest you give me a call. 5 months wages is significant.

I'd like to read the MOU.
