My mother and father live in Queensland. My father has recently been diagnosed with stage 4 pancreatic cancer. He does not have a will and we do not wish to bring this upon him at this stage. Will my mother face any problems due to the fact that my father does not have a will? What are the procedures? They own a house and a car.

It is always easier to have a valid will. If the assets are in joint names, it becomes easier without one but there may still be one headaches.

Your dad’s mind will probably turn to getting his affairs in order, if for no other reasons than to look after your mum and as a partial diversion from his own situation. Once he puts a will together he can can set his and your mum’s mind at rest for some of the ‘what comes after’ worries.
