Hi guys, as the title states, there are receipts for items purchased to the value of over $15000, items were purchased for horses and consist of 3 shelters and a buggy (there are other items that also have receipts, but the 4 items mentioned are the main concern)
The owner of the agistment centre was given 2 weeks notice of horses being moved and all agistment and expenses were up to date and nothing owing.
But this lady went nasty and virtually said she had spoken to a friend who is a lawyer and was told she didn't have to return any of these items because, apparently, they were a gift.
So a lawyer was paid for and an official letterhead stamped paper was sent to this lady stating the date and time in which the horses were being moved and shelters etc dismantled and taken away.
Long story short, when the day came only the 4 horses were permitted by this lady to be taken and everything else was refused. To the point if her blocking the driveways with cars so the gates were unacceptable and she herself called the police and told them that she felt threated and that there were trespasses on her property etc.
Police advised that the matter was a uvil suit and they could do nothing, even though receipts and everything were at hand to be shown as proof of ownership.
So everything, except for the horses was left at the property and now we are unable to collect anything belonging to us as we will be charged if we enter her property and she said if we want anything then to tale her to court.
Lawyer sent another letter and stated it was unlawful to keep these items etc and gave a new date for this lady to contact her and work out a new time to organise the collecting of the property.
This lady wrote back that she will allow only one shelter to be removed and everything else isn't going as she is still claiming said items were gifts.
Have already spent $3000 on lawyer and now another $1000 is requested to write back or take things further.
The main thing I find issues with us that I believed that receipts were proof of ownership etc and why on earth is it ok for someone to lay claim to possessions they haven't paid for on their word that things were a gift?
What is the point of keeping records and receipts if they don't help you to keep your property?
How is it fair?
Just at the breaking point of all this, and the fact that this lady is looking like she gets to keep these items, valued quite highly, by just refusing to give back and lying her way through this.
Hope someone can make it all make sense to me because right now I'm so angry and confused and still spending even more money just to try and get property back that already belongs to me..
