Hi everyone,

I'm full-time permanent on salary and my contract states that I do 40 hours per week. My employer is asking me to work a full weekend and not get paid for it, even though I will have already worked 40 hours that week.
a) is that legal? One of my coworker thinks it is because we're on salary, but I thought anything above 38 hours was meant to be overtime, salaried or not.
b) I'm assuming the boss won't want to pay us the overtime regardless, so should I ask for time in lieu instead? Would it be one hour of weekend work gives me 1 hour of time in lieu, or 1 hour of weekend work gives me 2 hours of time in lieu?
c) or does anyone have a better solution?

My partner is on a salery 38hrs. Any over time are paid via hours he can clock up for holidays.

Go with option b. Time in lieu and negotiate a suitable swap for time (eg 1 hr for 1 hr)

Working a whole weekend is unlikely to be reasonable.
