I am wondering if after contracts are exchanged unconditionally you find out that a final occupations certificate was never issued for the property can you terminate or contract or no as the cooling-off period has expired? thanks
I have looked into it a bit more and the property was built at the time of the old legislation where you could not commence occupation unless an OC has been issued but this doesn't apply if you have lived in the building for more than 12 months. I guess i could ask the seller to apply for an OC before settlement but they wouldn't have to agree. Down fall would be selling it in the future knowing there is no OC.
