My husband C was told out of the blue on Wednesday (26.6.17) that his boss has sold the business (6 employees) and the new owner will take over today. C was being 'let go'. He has worked for the company full-time for 17 years. There was no formal employment contract. He was given paid notice to the end of July but told he doesn't have to work out this notice.
His boss was aware that C has to have a hip replacement in the coming months, and in fact the hospital has just provided the date of 18.7.17.
My questions are:
1. Is the employer obligated to pay anything further to C? He is 54 years of age.
2. Would it be worth arguing that because the employer knew of C's need to take six weeks off to recover from the hip replacement he chose to terminate his employment.
