Hi there. I was away in Brisbane over the holiday period and have received an infringement notice for failure to stop at a traffic light, even though I was stopped, otherwise the office could have not fined me, as he was a pedestrian crossing the road. I live in Sydney and I want to fight this infringement, as I believe I shouldn't have got it, I also have a clean driving record. What I want to know is if it is worth pursuing this in court and if I do pursue it would I have to present myself in a Brisbane court or if I can appear by video link from NSW.

Can you 'prove' you stopped?

If not then your out of luck, because the traffic law system works based on the presumption of guilt - whatever a policeman decided you did, YOUR GUILTY under law unless you can prove otherwise.

Also, where did you stop. If it was over the unbroken white line, for example, then you’ve failed to stop.
