My wife recently hit a cyclist who ran a red light, while she was making a right turn in an intersection in a car... The cyclist was an Indonesian tourist, and has now filed a civil suit against her.

To make things more difficult, we have since moved to Germany so have no residence in Victoria. The only reason we found out is because the legal letter was sent to my wife's mother's house.

If both parties (the cyclist and also my wife) are not living in Australia. How should we proceed? Are we obliged to respond from Germany? Does anyone have any recommendations?

Did police attend the accident scene?

Other witnesses? Ambulance?

Your wife's mother should not have opened the letter but returned it to the post writing 'not at this address' on it. Also your friends and family should be aware not to volunteer any information about you at all unless compelled to by law.
