NSW How to Gain Custody of Children?

I am in new South Wales. I have 3 boys who have always been in my care. I have an older son who lives with my brother in Queensland. They have parenting orders but have not abided by them.

I am wanting to gain custody of children for my son. Will this be as difficult as all the research I'm doing shows?

Why won't your brother give you the kid? How did it come that he was living with your brother?

Something personal happened and I asked my mother to come down and and take him while I got myself into a better state. I found out I was pregnant due to the event I won't mention on a public forum.

I just wanted a week to pull myself together. I was having no problem parenting; I just couldn't allow myself to show any emotion in front of my son so needed that time. My mother never returned him and my brother and mother went for permanent care of him

How long has the son been in QLD with brother? Why won't they return him?
