I worked for a year for an employer who didn't give pay slips, didn't lodge the taxes we paid and didn't pay our super. Some staff are also owed wages, if asked about this he would fire staff and then refuse to pay them and call them bullies. He also owes several of the wholesalers he uses money for services rendered. Many of us have filed claims with the ATO and fair workers ombudsman but so far to no avail. He continues to run his business and his activities are premeditated. He hires knowing he has no intention of giving pay slips, filing taxes or paying super.
Can we do a class action as this entails every single employee that have worked for him. What's steps do we take?

A class action is possible. The FWO is a cheaper alternative for wages, as is the ATO for super.

Keep in touch with the FWO as they may well take action on your behalf. If they don't proceed with enforcement, then call around for lawyers in NSW who can manage a class action claim.

For a class action, you’d need to gather all affected employees and see if a lawyer can help with the process. It might be a good idea to document everything, like missed payments and communications with the employer. You’re on the right track with the ATO and Fair Work Ombudsman, but sometimes it helps to get legal advice to explore all your options. And definitely check out employee rights for more information on what steps you can take next.
