Hi,

Matter coming up for first ever appearance in Federal Circuit Court - can anyone explain how adjournments are decided?

The mother received help from the health nurse to ask for adjournment on basis she has just had a baby, is struggling with getting feedings sorted and looking after other siblings whilst trying to respond to a 145point affidavit.

Contacted an advice line and they simply said to email judge's chambers... Has anyone done this before?

I'm not sure who you spoke to on the other end of the telephone, but did she/he mean for you to email the Judges associate if the other side agrees to an adjournment?

Usually you would need to write to the other side (or their lawyer if they are represented) seeking agreement for an adjournment. Then after getting agreement, you would then notify the Court.

Federal Circuit Court Rules 2001 - Rule 10.02

Adjournment of first court date


(1) If the parties agree that, because of short service or other special circumstances, it is not appropriate to proceed on the date fixed the parties may ask a Registrar in writing to adjourn the first court date to another date.

(2) The Registrar may adjourn the first court date to the date requested by the parties or to another date that is practicable.
