Hello, my mother is an applicant in an NCAT matter against the Owners Corporation. For 2.5 years she has lived in black mould due to a roof leak. The committee has refused to repair/ fix the roof because they don't want to spend any money and they aren't impacted. NCAT has directed my mother to obtain an expert witness report. My question is as a pensioner why does my mother need to pay for the expert witness report over a common property asset? Shouldn't have the member directed the OC to pay for it. The roof belongs to everyone. I know that the onus of proof is on the applicant, but we would like some guidance. (STrata legislation is worthless. The owner way you can enforce it is with going to court and spending many thousands of dollars, that the majority of people don't have.)
