In the 2 years since separation I have paid over 100k off the mortgage, for a property that my ex lives in. I wanted to keep the property a nest egg but allowed him to stay to help him get back off his feet. He has since filed a claim to have the property transferred into his name and since I received his lawyers letters I have stopped contributing to the mortgage. Now he has too and the bank is calling. If I have paid most of the money and he is living in the property (with a boarder no less), than is he responsible for paying the bank? Will be both have defaults against our names?

You should try to negotiate with the bank. You'd be surprised how reasonable they can be...

Even the defaults are not that big a deal...

You need to find a lawyer, preferably sooner rather than later.

You may also have a claim to part of the rent money.

What part of Vic are you in?
