I recently left my husband of 17 years DVO in place. Due to having to leave in a hurry I was unable to take my car with me. It was an old, car and I do have a new car.Now my husband had two cars at the time of seperation, however had a car accident which resulted in one being totally. He is now refusing to return my car as I wish to sell it to pay outstanding debt, he said he would pay many times which did not. This is placing my credit rating at risk. I was advised by his lawyer that it was part of the asset pool, however so was the caravan he sold, just after seperation ( nil amount sold for disclosed to me) and he has stated that he will sell a tractor to pay outstanding debt. However it appears he is allowed to keep my car and sell items as he pleases. The car rego is in my name, as is the final loan documents.He is running my car all over the place ( as in 1000km trips) racking up the KMs on it, therefore decreasing the value.
He is claiming he needs the car to transport the kids, no formal orders, DVO in place, I plan to fight for supervised visitation.
