Hi,

Just wondering if an ICL has the ability/power to act in contravention of court orders?

For example, if an order states Family Report interviews are to be conducted after the completion of 3 supervised visits but the ICL arranges for the interviews prior to visits - can this be done?

Whoever is required to do the supervised time would probably benefit from pointing out to the ICL that the family report isn't meant to be completed until after the supervised time takes place, but overall, the ICL is probably working with what they've been given. Family consultants don't always coincide with contact centres, so sometimes, they do what has to be done. I don't think the Court is going to be terribly phased.

It may work for you in that it provides an opportunity to appeal against the findings in the report if you don't like them and court orders aren't followed. Conversely it may cost more money for another report.

You need to work out what is best for your child/ren.
