Hi,
After some advice. My sister after 6 years has ended her relationship. Her partner at the time did work on her car and told he would take car of the bills (writing them off through his business) now that they have split he has back dated (up to 3 years) and issued her with invoices purely to get back at her for leaving him.
Does she have any rights here? She was issued the invoices about 4 weeks ago but they are dated back to like 2017 - 2018 and don't all list her car rego or what was actually done or cost of parts. He has yesterday given her a badly written letter of demand

He's got no chance .... apart from anything else the small claims court would throw it out on the basis that's it's a claim that is under the jurisdiction of family law...

As far as a claim via family law as part of a property settlement, also not going to be accepted.

Does it matter that they were never married or living together? He issued her invoices through his business and is trying to claim that they were "business transations"

You wrote that your sister ended their relationship. Assuming you mean a couples type relationship then no it won't matter... Even if he took it to small claims court claiming they never had a relationship , on the balance of probabilities, no magistrate is going to accept that they were not after backdating invoices for work done 2-3 years ago..

I recommend your sister ignore the letter of demand or just politely decline.
