Hi,

My tenant has caused damage to a bathroom cabinet by allowing the sink to overflow, this has caused significant damage to the cabinet and doors below.

We are in Perth, WA and the apartment is about 15 years old and as far as I can tell it's the original sink and cabinet that was installed.

They are saying it's a bad design because the sink didn't have an overflow hole near the top.

Any thoughts on who should be liable to pay for fixing this under property law?

I would say the tenant. But I would just replace it. The last thing I would want is a pissed off tenant in the house not paying rent and damaging the house over something that is 15 years old and would due to be replace soon anyway but that is just my two cents

Hi,

Thanks for the replies. It was noticed during final inspection so the debate now is about the release of the security bond.
