I am in dispute with a seller who failed to supply me with an order (lights) in reasonable time (took them 22 days when their website said in stock and failed to communicate this to me during several subsequent opportunities).
I raised this with FairTrading but they were unable to mediate successfully and in the end the seller did not respond to FairTrading's final notice within the stipulated time. I have not gone to the NCAT as a matter of principle.
I am spending $60 on the appeal, not counting the time I will invest in it and the day off that I need to take to go for the hearing. I have sought a full refund of my order as part of the appeal. Are the costs associated with this appeal automatically considered for being paid to me in case of a decision in my favour or do I have to specifically ask for it? And in case of the latter, where and how do I do this?
