Hello,

My enquiry is in relation to a mobile phone account of a friend who works for a telco. Her account has been accessed without consent by another employee at the telco. As a result of this action several people have been contacted and harassed by the colleague. Currently being investigated by the relevant HR and corporate security teams (personal email also accessed using work resources) however are there any avenues to pursue this outside of the telco once proof is obtained that he has access her account.

Any information appreciated.

Hi there

To get things started, this will depend on the nature of what the rogue employee did and the consequences for your friend, for example whether he was defaming your friend.

I wonder whether this would amount to an 'interception' under the Telecommunications (Interception and Access) Act 1979. This act makes it a Commonwealth offence to intercept communications including SMS passing over a telecommunications system except in specific circumstances such as where law enforcement agencies have a warrant or emergencies.
