As the PINOP, you are not the person restrained by the AVO.
If the
only thing in play is an AVO, then yes, you can
pretty much come and go as you like.
But -> You do
not get to take the/any kids overseas.
There are a few ifs and buts that you need to consider though.
The first and foremost being that, even if you could get a flight,
there's nowhere better than Australia, COVID 19-wise.
Going anywhere else right now is madness.
Further, remember that if you are required for further court proceedings,
then you have to stay.
For example, if the police want you as a witness in respect of
charges laid (against, say, your boyfriend) because of whatever happened
that led to there being an AVO,
then you are required to turn up to court.
So if for example, the police want you to come to court,
then no, you don't get to run away overseas from that.
Further, if there are other legal things in play
that might require a PINOP to live at a specific place,
then they can still apply.
Examples of what I mean (none of which may apply to you)
include (but are not limited to)...
- further court dates where you will be required
(say, as a witness), or
- Parenting Orders about any children you have, or
- any Bail Conditions that may apply to you, or
- any relevant Visa conditions, or
- the terms of a CCO (these can require a person to live a certain place as one of the terms)
