Hi all,

Hope someone can answer this...

I am an Australian Citizen, my brother is a South African Citizen (living in the UAE for the last 15 years). He went to a lawyer to set up his Will and was told to appoint someone outside of the UAE as guardian of his kids.

He asked if I could be the guardian...Of course I would, but what are the legal steps if something should happen to my brother and wife? Will I be able to get the kids into Australia? Where can I find out about this?

Hi,

Your brother would probably be best placed to speak with a UAE lawyer to determine the legalities of (and I'm not sure of the children's nationality) getting children residing in UAE relocated to Australia. I'm uncertain how you go about picking them up and leave the country with them.

From our side its pretty simple. Get them into the country and submit an Orphan relative visa (subclass 837) Orphan Relative visa (subclass 837)

It would have to be a stone cold assessor who rejected an orphaned child in this situation.
