Dispute has arisen with builder in Noosa as the 10 week build is now in its 38th week. Last week for the fourth time a subcontractor has not turned up (don’t actually believe it was ever organised), told builder we’ve had enough and to leave the property. He demanded full payment to which we refused (all invoices are paid and up to date) to which he threatened to place lien on the property. What recourse do we have to challenge the lien or does that not happen at the moment the lien is applied for? Not concerned as the builder is so far beyond the timeline and would be uncontactable for weeks at a time with no warning, but just want to minimise the hassle.
