My question is, can I take a self-storage facility to court for compensation for goods sold in breach of the Warehousemen's Lein Act?
The contract terms are very unfair and do not correspond with what is outlined in the Warehousemen's Lein Act 1958 Vic.
As of the 2nd of Nov, I was behind on my monthly storage payments for two months totalling $1260 when I received a notice that if my account was not brought up to date in 4 days then I would have my access restricted and if I did not pay within 2 weeks then they would sell my belongings at auction.
I then received another invoice with random amounts ,I asked for a break down of costs which was denied.
On the 11th Nov, my storage container was forcefully opened, a large amount of my belongings were removed and photographed and then listed on ibidonstorage.com.au.
I asked for a payment plan so they might not sell pretty much every thing I owned, the storage facility declined any payment plan or any reasoning for the new charges now totalling $2793 only stating to “pay my bills or goods will be sold” and that they did not have time to answer my questions.
These items sold with In 2 auctions on the 16th Nov and the 27th November for a total of $1781, items such as my ice hockey equipment worth $10,000 sold for $66, many person items like my ice hockey award medals were never returned I’d personal effects such as birth certificate and photos.
Total estimated value of the contents of my storage is over $100,000
A few months laterI received an email saying, give me $200 for your ice hockey gear, replied and agreed, i never heard back from the storer.
9 months later another large amount of my belongings had been auctioned by the same storer on ibidonstorage.com I only found this out as I googled the storgage facility and it linked me to the recent auction, I had no knowledge of this action, as far as I was aware all of my belongings had been sold, this action sold for $793.
4 months laterI received an email from the storer saying give me $250 for your ipad back.
All of my tools were inside my storage container along with 98% of all my possession, I could no longer work, I fell deep into depression and have had a very hard time getting myself back on my feet.
I have not taken any action sooner as Re living this event brings a lot of trauma and is something I have have been blocking out to try and move forward, also legal fees are expensive and I’m not really sure where I should enquire for assistance.
i Have a huge amount of-evidence to support this and-have kept all emails and communication.
