Hello everyone

So this is what I did, I threw a plastic coke bottle trying to get it into the bin but missed outside of Birdees, and the council saw and gave me a fine. They took my licence to check proof of identity for the infringement notice “Waste reduction and recycling Act 2011”, but they misplelled my last name on the notice. Does the misplelling of my name mean anything?

So now what happens if you don’t pay the fine, will they increase it? Take me to court? And if they did, and I still refuse to pay what happens then? Because I don’t have any assets cause I’m 19 and living with parents, I don’t own a car or a house or anything. But they can’t also send me to jail for littering cause that would be ridiculous. Have a found a way to cheat the system for this kind of offence? If not, what can i do to make there life’s difficult as possible and get away from it.

The misspelling of your name isn't going to get you out of it, but it might delay them tracking you down a bit.

If you don't pay the penalty and they decide to proceed to take the matter to court, you fine can increase dramatically. These amounts may be old, but in the order of $227.00 for an infringement notice - with the maximum penalty in court being $3,415.00. The maximum penalty would be rare, especially without aggravating circumstances.

From there, they'll send the order to SPER. The can add an enforcement fee (currently $116.85, I understand). If you fail to pay SPER, they have a range of enforcement options including suspending your driver's licence, and deduction from wages and bank accounts.

So, have you found a way to cheat the system? No. What can you do to make their 'life' difficult? Nothing. Pay the fine. Even if there was something you could do, this is not the place to be asking for that sort of answer. If you did the wrong thing, own up to it and move on. Any trouble you cause will likely harm you more in the long run.

Thank you for response. Well currently I am not working and don't have any money in the bank, so what can they do then, because the way I see it if I keep ignoring them they can't do anything about it, they can't force me to pay anything because they don't have the right to control my actions.

You don't think the law hasn't already dealt with people with attitudes like yours?? You are not first, you will not be the last.

Of course the Government doesn't control your actions. What the Government does is penalise those actions it deems against the law. You can go out and steal a car and the government can't stop you. What they do later is put you in jail for your actions.

How far this goes just depends on whether there is someone willing to push the matter and chase you.

If it goes to court, and you fail to follow court orders, things escalate to contempt of court. Courts don't like people disobeying their orders so they then have access to a wider range of measures for contempt of court which includes jail.

You don't get to cheat the system. You might get lucky and be forgotten about, and that is the best you can hope for. If they pursue you and you refuse to co-operate, a short time in jail might be the result.

I don't think this is why you fined. I think you were fined for not putting it in the bin after you missed.

People simply want a nice place to live and that is hard when wading through piles of trash. Time to grow up and stop thinking the 'system' is out to control you.

You don't have any money? Do you intend to always be this way? hope not and you'll owe more money. It could impact on credit ratings too... So when you do get a job, save hard and want to borrow some money for a car or what ever, it could show up on a credit check, especially if it blow out to a few grand through court etc etc...

They will catch up with you.I'm betting old mate that wrote the ticket took down your drivers licence number, so the name being mis-spelt means nothing...
Call council ask if they'd agree to periodic payments of $20 a fortnight.

They don't have the right to control your actions? U'm yep they do. Fortunately, for you, you also have some control over your actions. Put it in the bin...

You missed the bin? I bet you didn't go back and pick it up?
Mate you're not gonna get the answers you want here. But they are the right answers.
